QUAKER’S START WITH SUBSTANCE
TERMS AND CONDITIONS

  1. ACCEPTANCE OF TERMS
    By accessing and using the Start with Substance Facebook page from The Quaker Oats Company (“Quaker Oatmeal”), you accept and agree to be bound by the terms and provision of the Facebook Terms of Service. See the Facebook Terms of Service at http://www.facebook.com/home.php#/terms.php?ref=pf.
  2. DESCRIPTION OF INITIATIVE
    For each qualifying UPC entered, Quaker Oatmeal’s Start with Substance initiative will donate one bowl of oatmeal to Share our Strength (up to 1,000,000 bowls). The program will run from January 12, 2009 to February 28, 2009.
  3. FACEBOOK PRIVACY POLICY
    Registration Data and certain other information about you are subject to the Facebook Privacy Policy our applicable privacy policy. For more information, see the full Facebook Privacy Policy at http://www.facebook.com/policy.php?ref=pf.
  4. MEMBER CONDUCT
    Quaker Oatmeal’s Start with Substance Facebook page reserves the right to remove Content that it deems inappropriate or obscene.
  5. CONTENT SUBMITTED OR MADE AVAILABLE FOR INCLUSION ON FACEBOOK
    Quaker Oatmeal does not claim ownership of Content (as defined in the Facebook Terms of Service) you submit or make available for inclusion on Facebook. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of Quaker Oatmeal’s Start with Substance page, you grant Quaker the following worldwide, royalty-free and non-exclusive license(s), as applicable:
    1. With respect to photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of Quaker Oatmeal’s Start with Substance Facebook page, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on Facebook solely for the purpose for which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on Quaker Oatmeal’s Start with Substance Facebook page and will terminate at the time you remove or Facebook removes such Content from Quaker Oatmeal’s Start with Substance Facebook page.
    2. With respect to Content other than photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of Quaker Oatmeal’s Start with Substance Facebook page, the perpetual, irrevocable and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.
      "Publicly accessible" areas of Quaker Oatmeal’s Start with Substance Facebook page are those areas of Quaker Oatmeal’s Start with Substance Facebook page that are intended by Facebook to be available to the general public. By way of example, publicly accessible areas of the Quaker Oatmeal’s Start with Substance Facebook page would include the accompanying Discussion Boards and downloadable photos. However, publicly accessible areas of Quaker Oatmeal’s Start with Substance Facebook page would not include Facebook services intended for private communication such as Facebook messaging service.
  6. CONTRIBUTIONS TO Quaker Oatmeal’s Start with Substance Facebook page
    By submitting ideas, suggestions, documents, and/or proposals ("Contributions") to Quaker Oatmeal’s Start with Substance Facebook page through its suggestion or feedback webpages, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Quaker Oatmeal is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Quaker Oatmeal shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) Quaker Oatmeal may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of Quaker Oatmeal without any obligation of Quaker Oatmeal to you; and (f) you are not entitled to any compensation or reimbursement of any kind from Quaker Oatmeal under any circumstances.
  7. NO COMMERCIAL REUSE OF Quaker Oatmeal’s Start with Substance Facebook page
    You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion or use of, or access to, the Quaker Oatmeal’s Start with Substance Facebook page
  8. TRADEMARK INFORMATION
    You agree that all of Quaker Oatmeal’s trademarks, trade names, service marks and other Quaker Oatmeal logos and brand features, and product and service names are trademarks and the property of Quaker Oatmeal. Quaker Oatmeal's prior permission, you agree not to display or use in any manner the Quaker Man.

QUAKER’S “25 BLOGGERS/25 DAYS” CONTEST
January 9, 2007-FINAL
OFFICIAL RULES

  1. HERE’S HOW IT WORKS: One blogger will be assigned to each weekday for 25 days, beginning January 12, 2009 and ending February 13, 2009. On the appointed day, the blogger will post details about the contest. Bloggers have editorial license to describe the contest in their own words; however, the following details must be included:
    1. Provide link to the Official Rules;
    2. Provide link to the Facebook page;
    3. Disclosure that Quaker has provided her with two coupons, each good for $1.00 off any 2 Quaker Oats’ products to award to her readers and a case of oatmeal for her local food bank;
    4. An invitation to her readers (“Readers”) to go to the Facebook page, download the image of the Quaker Man, print it, take a photo or video of themselves or their family with the Quaker Man, upload it to the Facebook page and submit the link to her comments section. The photo or video must be taken in the reader’s home with their family member(s) or feature just themselves. All submissions are subject to the Facebook Terms and Conditions;
    5. The Quaker Man logo must remain in intact and may not be modified in any manner. Readers must use the exact download of the image, and all entries need to be wholesome in nature. No nudity, defamation, obscene language or inappropriate, rude behavior in the photograph submitted will be accepted. Compliance with these rules is subject to the sole discretion of The Quaker Oats Company;
    6. This program is taking place over 25 business days and the blogger who gets the most Reader submissions by 9 a.m. CST the following morning, (within 24 hours) will win the opportunity to select a hunger charity of their choice to receive a $5000.00 donation made to the charity by The Quaker Oats Company.
  2. TO ENTER: Blogger must post the above on her assigned date. Only those submissions received by 9:00 a.m. CST the following morning will be valid.
  3. JUDGING CRITERIA: Only valid comments will be tallied. The blogger with the most valid Reader comments will win the donation designation. Limit one comment per person/per email address. Judges reserve the right to void any comment that is not submitted within the spirit of this contest and will be disqualified. The winning blogger will be determined on or about Friday, February 20, 2009.
  4. PRIZE: One (1) Grand Prize: Opportunity to select a hunger charity of the winning blogger’s choice to receive a $5,000.00 donation from The Quaker Oats Company. The selected charity must be a 501(c)(3) organization. The Quaker Oats Company will make the donation directly to the designated charity. Winner cannot take a tax deduction for this prize donation on their 2009 personal income taxes.
  5. ELIGIBILITY: Open only to bloggers who have been invited to participate by Sponsor and who publish their post on the appropriate day, following the guidelines outlined above. Void where prohibited by law. This promotion is subject to all federal, state and local laws and regulations. Participant must be a Facebook member. If you are not a member but would like to participate, membership is free.
  6. DISCLAIMER: Sponsor and its agencies are not responsible for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized with respect to this contest. In no event will Sponsor be liable for more than the stated number of prizes in Rule #4.
  7. GENERAL RULES: Sponsor shall receive a perpetual royalty-free worldwide license to use all Content (as defined by Facebook Terms and Conditions) submitted (by both entrants and Readers) in connection with this program in any and all media. Entrants agree to abide by these Official Rules and by the decisions of the judges, whose decisions are final in all matters relating to this promotion. By participating as an entrant or Reader, you agree to hold harmless Sponsor and its parent company, subsidiaries, affiliates, directors, employees, officers and agents, including without limitation, their advertising/promotion agencies from any and all liability, injury, loss, or damage of any kind to property or person(s), directly or indirectly, from or in connection with participation in the promotion.
  8. WAIVER: By entering this promotion, participant waives all rights to claim punitive, incidental and consequential damages, attorneys’ fees or any damages other than actual out-of-pocket costs incurred to enter.
  9. WINNER’S LIST: The winning entry will be posted on the Quaker Facebook Hub.
